Overview

This position assists in the execution of Prime Contracts in conjunction with the Program Manager and Project Directors. This role is responsible for large, complex, federally funded, and highly complex construction projects. Ensure compliance with government regulations, statutes, and Company Practices. This role is assigned to an organization supporting mid to large projects in domestic and overseas locations with high risk. Undertake Prime Contract management execution activities in accordance with the Prime Contract, Federal Acquisition Regulations, and Agency Supplements, and the Mission Solutions’ Prime Contract Management Practices, with a view to preventing revenue leakage and effectively identifying, manage adjudicate scope creep to ensure equitable reimbursement is received for all changes.

Provide support to Project Management in the execution of the prime contracts, including participating in the strategy sessions, development of change order proposals, prime contract review, joint venture and/or subcontract partnering, and project risk assessment process.

Facilitate a smooth transition from Award to Execution to Closeout with the support of the Project team throughout the life of a project. Coordinate with Project Controls, Project Business Services, and Legal on Project operations issues. Review and preserve project correspondence to ensure Fluor’s contractual and legal rights are protected and consistent with the terms of the prime contract. Develop Contract Summaries and Prime Contract Management Plans and Responsibility Matrix(s) and update them throughout the project lifecycle. Participate in cross-functional management team reviews.

Provides leadership and management for all Project Prime Contract functions to include daily interface with the

Government Contracting Officer(s) and DOE Operations Management members.

Provides leadership and management assistance/support for the solicitation of awards, administration, and closure of subcontracts in accordance with Federal Acquisition Regulations (FAR) and Department of Energy Acquisition Regulations (DEAR), and the Project Procedures and performance compliance management functions for the Project related to Acquisitions.

As may be requested, assists Acquisitions Management in evaluating the activities of subcontracts personnel involved in bid and proposal efforts and the negotiation and management of subcontracts to assure compliance with Federal Acquisition Regulations and project policies and procedures

As may be required, assist Project Management in supporting government proposal activities including, but not limited to, analyzing solicitations; preparing summaries, and aid in developing strategies and recommendations based on the analysis, with attention to the financial and business risk of the proposed effort; participating in proposal team meetings; assist in preparing the terms, conditions, and basis of estimates and key assumptions upon which the proposal may be submitted, and participate in the review of technical and pricing proposals for accuracy and consistency. Responsibilities may also include coordinating with other company functions as required to ensure appropriate reviews are conducted, scheduling required reviews and obtaining required review and approval signatures prior to submittal of proposals or execution of contractual documents.

Works with the Project Managers to ensure that Company’s entitlement to additional time and compensation for changed conditions is properly documented and communicated to the Customer in writing.

Provides change order/claims identification, development, and presentation support to the Project team, assisting in the management and resolution of change orders/claims as required.

Develops or validates the list of mandatory and recommended prime contract flow-down clauses for incorporation into subcontracts and purchase orders and ensures those clauses are being incorporated as required; also generates or verifies the accuracy and completeness of the contract brief, summary, and abstract.

Other Job Requirements

Work with the project manager and project team to identify and maintain the prime contract baseline and ensure consistency with the Operating System Requirements (OSR) and Baseline Centric processes

As may be required, provide ongoing training in the various aspects of prime contract management to project managers and to other key members of the project team to address prime contract management principles, subcontract formation and administration, identification, preparation and resolution of change orders, and claims

Work with Construction, Engineering, Supply Chain Management, Project Controls, Business Services, Legal, and Risk Management to assist in facilitating organizational interfaces between those performing subcontract formation and administration

Ensure compliance to applicable Project and company practices

Maintain knowledge bank of Company and Project Prime Contract Management Practices

Provide specialized trouble-shooting to projects

Department of Energy contracting experience is not required but is highly preferred

Strong Construction Contract management, execution, and change management background are highly preferred

Requires a comprehensive knowledge of Federal Acquisition Regulations and industry business practices and management of prime contracts and subcontracts

Strong experience in pricing, a sound understanding of contract law, contract drafting, administration, and negotiation of change orders, risk identification and mitigation, effective correspondence, planning, and scheduling

Proficiency in the formation and administration of prime contracts• Proficiency in the formation and administration of subcontracts through the several steps of bidder pre-qualification, a compilation of bid requests, receipt of bids, bid evaluation, award, monitoring the performance of contractors, back charge procedures, resolution of claims and disputes, and other such related steps

Demonstrated leadership and teamwork capabilities suitable for working effectively in a matrix organization and working within a diverse workforce

Strong written and oral communication skills, excellent interpersonal skills

Minimum Requirements

Accredited four (4) year degree or global equivalent in applicable field of study and eighteen (18) years of work-related experience or a combination of education and directly related experience equal to twenty-two (22) years if non-degreed; some locations may have additional or different qualifications in order to comply with local requirements
